  • Does the Indictment of the Alleged Palin Email Hacker Hold Water?

    An indictment by a federal grand jury was issued in Knoxville, Tennessee with respect to the alleged hacking of Alaska Governor Sarah Palin's Yahoo email account. The defendant, David Kernell, the son of Tennessee Representative Mike Kernell, has pleaded not guilty. If convicted, David Kernell could be sentenced to up to five years in prison, along with a hefty fine and years of supervised release.

  • Metadata: Ethical Obligations of the Witting and Unwitting Recipient

    As shown in our last column, software commonly used by lawyers often creates embedded data, otherwise known as metadata. As previously discussed, there are means to avoid creating embedded data, as well as means available to remove hidden data already created. In theory, at least, it is possible to remove all metadata prior to sending a document to opposing counsel.
