Unfortunately, metadata has curtailed one of the courtesies attorneys in litigation formerly exhibited through providing discovery requests in an electronic format so that opposing counsel didn’t have to have his assistant re-type your requests when answering discovery.

It's a bit like the lawyers in Qualcomm v Broadcom: we can identify with them until the lying starts, and then we no longer see ourselves in their moccasins.

Superior Ct.), the Sixth Appellate District in California has interpreted the Stored Communications Act (18 U.S.C. §§ 2701-2712) as limiting the ability of civil litigants to obtain the contents of stored communications from Internet Service Providers (ISPs) through the subpoena process. While this is a narrow application of the law, the interpretation will significantly affect e-discovery strategies and tactics in California - especially when litigants cannot obtain the original communications from the recipient."
