Over 1,000 Cases Now Included in K&L Gates' E-Discovery Case Database
Electronic Discovery Law, 07/03/08
We are pleased to announce that our searchable case database now contains over 1,000 e-discovery cases from state and federal jurisdictions, with new cases being added every week. Now more than ever, our database is an excellent source of information on developing e-discovery case law around the country.

Remove Hidden Metadata from Word Documents
TechnoEsq, 07/02/08
Unfortunately, metadata has curtailed one of the courtesies attorneys in litigation formerly exhibited through providing discovery requests in an electronic format so that opposing counsel didn’t have to have his assistant re-type your requests when answering discovery.

Is E-Mail Evidence Less Persuasive?
EDD Update, 06/20/08
I suppose it says something about your status in life if you are pleased or appalled to see Wall Street titans with eight-figure incomes taken away in handcuffs and booked. It's a bit like the lawyers in Qualcomm v Broadcom: we can identify with them until the lying starts, and then we no longer see ourselves in their moccasins.

Thomson West Introduces Case Evaluator on Westlaw

Thomson West

EAGAN, Minn., Aug. 14, 2007 - Litigators have questions - about cases, about strategies, about any and all relevant information. Searching Westlaw for the answers - or even clues to the answers - just got easier. Thomson West today announced Case Evaluator on Westlaw, a new research feature that goes beyond a typical search and returns only the desired results unique to each query. West is a business within the Thomson Corporation (NYSE: TOC; TSX: TOC).

With Case Evaluator, for the first time litigators can build a fact base representing the outcomes of comparable cases - including verdicts, awards, relevant medical and expert witness data, and other criteria - and then generate Westlaw reports that can help sharpen legal strategies for the matter at hand. Case Evaluator enables users to select the criteria, jurisdiction and parameters so each report fits the unique type of case and fact profile.

"Case Evaluator gives a deeper view of cases in customized, concise, on-point reports," says Jeff Arvidson, director of Product Development, West. Using Case Evaluator, litigators can generate a full report or choose individual elements of the case. Litigators also can choose to run a national search or select a state jurisdiction for California, Georgia, New York, Ohio or Texas.

Case Evaluator allows litigators to:

  • Evaluate potential cases.
  • View verdict and settlement trends.
  • Examine trial court motions and memoranda.
  • Review appellate briefs, petitions and decisions.
  • Use medical resources and illustrations.
  • View analysis of experts included in verdicts and settlements, plus excerpts of their testimony.

"Attorneys often focus their litigation strategies by evaluating the potential for success given the facts of the case, and the dollar value of the case," Arvidson noted. "Litigators need to review whether similar cases in their jurisdiction have been decided or settled successfully, and analyze trends in order to see dollar ranges in similar cases - Case Evaluator provides that insight," he added.
